What should I do at the scene of a road traffic accident?

In today’s society is more important than ever to know what to do in the event of a road traffic accident. This is because the roads are becoming increasingly busier, and the harsh reality is that most people either have been or know someone who has been involved in a road traffic accident with an at-fault third party.

At PA Duffy & Co we understand that being involved in a road traffic accident can be an upsetting experience and shock can often set in. However, if you find yourself on the roadside having been involved in a collision it is important that you compose yourself and approach the situation in an intelligent manner.

You should immediately establish that you and any passengers in your vehicle are OK and ascertain if anyone requires emergency medical assistance. You should then exchange details with the other driver – name, address and insurance details. If it is safe to do so, take photographs of the vehicles at the scene. If you can take photographs before the vehicles are moved well and good but in the interests of safety, this is not always feasible. Take note or a photograph of the third party’s number plate. Check if there were any witnesses and take a note of their name and phone number. This list is not exhaustive but if you can remember to adhere to all or some of these you are helping to future proof any claim you may have.

Please be aware that you are entitled to independent legal advice if you have been involved in an accident with an at-fault third party. You are entitled to instruct your own solicitor if the accident was not your fault. The sooner your solicitor is involved, the greater your chances of success.

At PA Duffy & Co Solicitors we have helped numerous clients deal with the entirety of their claim. We are working independently for you to ensure that you are treated fairly and justly to the highest possible standard.
