P.A. Duffy & Co Solicitors Advise Families in Settlement Linked to Covid 19 Deaths at Cork Nursing Home

P.A. Duffy & Co Solicitors, a leading all-island law firm, has advised bereaved families in legal proceedings arising from deaths linked to Covid‑19 at a Cork nursing home during the pandemic.

The proceedings relate to the death of an 81‑year‑old resident during the third wave of the Covid‑19 pandemic in early 2021 at a privately operated nursing home in County Cork. The High Court was informed this week that the family’s claim had been settled against the operator of the facility. The details of the settlement remain confidential.

The case is understood to be among the first to reach the courts concerning alleged failures in the care and protection of nursing home residents during the Covid‑19 pandemic. Five families who lost loved ones at the same nursing home have now settled what have been described as landmark wrongful‑death actions, highlighting broader concerns regarding preparedness, infection control and resident safety during the public health crisis.

In the case before the court, it was alleged that the deceased resident had been unnecessarily exposed to the risk of contracting Covid‑19 at a time when outbreaks in nursing homes nationwide had already demonstrated the extreme vulnerability of elderly residents.

The wider set of actions being pursued by bereaved families is expected to return before the High Court in the coming weeks, as legal scrutiny continues around the treatment of nursing home residents during the pandemic.

Commenting on the development, Enda McGarrity, Director at P.A. Duffy & Co Solicitors, said:

“For families who lost loved ones under extraordinarily difficult circumstances, this process has never been about headlines or compensation. It has been about accountability, dignity, and ensuring that the lessons of the pandemic are fully acknowledged. These cases raise serious and important issues about how our most vulnerable citizens were protected during a national emergency.

Bereaved families should never have to resort to highly contentious litigation to obtain answers for the loss of their loved ones. However, the Irish Government’s failure to establish an effective Inquiry into the handling of Covid in nursing homes has left them with no other choice. Our clients repeat their call to the Irish Government to promptly establish an Inquiry so that lessons can be learned so that no one has to endure the same harrowing experience.”

P.A. Duffy & Co Solicitors has been instructed by a number of families nationwide in relation to Covid‑19 related deaths in nursing homes and has previously confirmed that multiple wrongful‑death actions have been initiated against both private nursing home operators and public bodies, depending on the circumstances of each case. The firm also acts for Northern Ireland Bereaved Families for Justice in the UK Covid Inquiry.

The firm continues to act for bereaved families with sensitivity and discretion while the legal process unfolds.
